DRE Advertising Regulations

Hillcrest Lending complies with the advertising requirements set forth by the California Department of Real Estate, including but not limited to the following regulations:

Broker Identification (B&P Code 10140.6)

All advertising by Hillcrest Lending includes the responsible broker's identity as licensed by the Bureau of Real Estate. Our DRE license number (02114219) is disclosed on all advertising materials.

Multi-Lender Disclosure (RE 559)

When arranging loans through multiple lenders, Hillcrest Lending provides the RE 559 disclosure as required. This disclosure informs borrowers that we may receive compensation from the lender for the referral of the loan and that the borrower may obtain a loan directly from the lender without paying a broker's commission.

Threshold Reporting (RE 858)

Hillcrest Lending complies with the DRE's multi-lender threshold reporting requirements under RE 858 when acting as a broker for trust deed investments. All required reports and disclosures are filed with the DRE in accordance with applicable deadlines and requirements.

Interest Rate and APR Disclosures

In compliance with the Truth in Lending Act (TILA) and Regulation Z (12 CFR Part 1026), the following disclosures apply when interest rates are advertised:

When an interest rate is advertised, the corresponding Annual Percentage Rate (APR) is also disclosed. The APR reflects the total cost of the loan, including interest, points, and certain fees, expressed as an annual rate.
Advertised rates are subject to change without notice and are not a commitment to lend. Your actual rate may differ based on your creditworthiness, property type, loan-to-value ratio, and other factors.
Rate quotes provided on this website or in other materials are for illustrative purposes only and may not include all fees and costs associated with the loan.

Sample Payment Disclosure

Example: A $500,000 loan at 10.99% interest rate for 12 months with 2 points origination would have an estimated monthly interest-only payment of approximately $4,579.17. The APR for this example would be approximately 13.15%. This example is for illustrative purposes only. Actual rates, terms, and payments may vary. Points and fees are paid at closing and affect the APR. Additional fees such as appraisal, title, escrow, and recording fees are not included in this example.

The interest rate and terms available to any individual borrower will depend on a variety of factors, including but not limited to:

Final loan terms will be set forth in the borrower's loan documents, including the Promissory Note, Deed of Trust, and the Mortgage Loan Disclosure Statement (RE 882/883).
