The Holden Act (California Health and Safety Code Sections 35800-35833) is a California state law that prohibits financial institutions, including mortgage lenders, from engaging in discriminatory lending practices. The Holden Act applies to all real estate-secured loans and specifically prohibits redlining — the practice of denying or varying the terms of a loan based on the geographic location of the property.
Hillcrest Lending does not engage in redlining or any form of geographic discrimination. Our lending decisions are based on the merits of each individual loan application, including the creditworthiness of the borrower, the value and condition of the collateral property, and the borrower's ability to repay the loan.
The Equal Credit Opportunity Act (15 U.S.C. 1691 et seq.) and its implementing regulation, Regulation B (12 CFR Part 1002), prohibit creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex (including sexual orientation and gender identity), marital status, age (provided the applicant has the capacity to contract), receipt of public assistance income, or the good-faith exercise of rights under the Consumer Credit Protection Act.
